UK Supreme Court: Legal Definition of Woman Does Not Include Trans Women
The United Kingdom’s Supreme Court has ruled that the legal definition of “woman” does not include trans women, a decision that could significantly impact the application of equality laws.
In a unanimous verdict, the court stated that the term “woman” in the context of equality legislation pertains specifically to “biological women and biological sex.”
The key issue before the court was whether trans women holding a gender recognition certificate (GRC), which legally recognizes their female status, are entitled to protections against discrimination under the Equality Act 2010.

The legal challenge originated in Scotland in 2018, where a group of campaigners contended that these rights should solely protect cisgender women. Conversely, the Scottish government maintained that trans women with a GRC are legally considered women and should receive the same legal protections.
While the case was rooted in a discussion regarding board quotas under Scottish law, the ruling is likely to influence the increasingly contentious and divisive discourse surrounding transgender rights throughout the United Kingdom.
